RELEASE OF LIABILITY AND EXPRESS ASSUMPTION OF RISK

RELEASE OF LIABILITY AND EXPRESS ASSUMPTION OF RISK for Rion Motors, Inc., dba Rion Motors (“Rion” or “Released Party”)

By signing this waiver, I am indicating my intent to use one of Rion Motors’ electrically powered items that it holds out for sale including electric scooters (hereinafter referred to as “electrically powered vehicles”) in or at Rion’s premises or outside of Rion’s premises. ​I understand that use of these electrically powered vehicles is inherently dangerous and my use of them is done at my own risk. In consideration for being permitted to use the electrically powered vehicles, I agree to waive, release and discharge Rion, and any of their related companies, officers, directors, instructors, employees, agents, and co-participants from any and all liability, claims or causes of action whatsoever for injuries, damages, claims or causes of action (known or unknown), including without limitation, any bodily injury or disability, illness or disease, accident, death, financial loss, property loss, damage, destruction, delay inconvenience or other harm of whatever nature that may be directly or indirectly related to my use of the electrically powered vehicles, arising out of any negligent act or omission or breach of any express or implied warranty of the Released Party. I acknowledge that Rion is a light electric vehicle manufacturer (LEV) and provider and sells items that it does itself manufacture or place into the stream of commerce for individual use. ​I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I AM WAIVING ANY RIGHT THAT I MAY HAVE TO BRING ANY LEGAL ACTION TO ASSERT A CLAIM AGAINST RION ARISING OUT OF RION’S NEGLIGENCE. ​I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTY, JOINTLY AND SEVERALLY, AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS, RIGHTS, LOSSES, COSTS, DAMAGES, EXPENSES, SETTLEMENTS, JUDGMENTS, CAUSE OF ACTION, AND LIABILITIES OF ANY KIND WHATSOEVER, WHETHER FORESEEN OR UNFORESEEN, INCLUDING ATTORNEYS’ FEES, IN LAW OR IN EQUITY ARISING OUT OF OR RESULTING FROM ANY CLAIM RELATED TO MY USE OF THE ELECTRICALLY POWERED VEHICLES. This waiver and release is intended to be interpreted as broadly and all-encompassing as permissible under California law.

ASSUMPTION OF RISK

I agree that my use of Rion’s electrically powered vehicles is done at my own risk. I understand that my presence at Rion’s premises and use of Rion’s electrically powered vehicles carries with it certain risks, known and unknown, including but not limited to the risk of serious personal injury, disability, or death, and fully assume that risk on my own behalf and on behalf of my heirs, assigns, and/or agents. I agree that I am voluntarily present and/or my use of the electrically powered vehicles is voluntary and I assume all risks of injury including, without limitation, injuries or damages which may result from my use of the electrically powered vehicles, including injuries or damages arising out of Rion’s negligence. I accept full and complete responsibility for my own safety and for any damage, theft, loss or injury caused by others to me or by me to others in my use of the electrically powered vehicles, including any damage I may cause to any property. ​I hereby release Rion and any of their related companies, officers, directors, instructors, employees, agents, and co-participants from any duty of reasonable care to protect me from injury or damage.

I HAVE CAREFULLY READ THE FOREGOING RELEASE OF LIABILITY AND ASSUMPTION OF RISK AND UNDERSTAND ITS CONTENTS. I HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT AND I VOLUNTARILY SIGN IT WITH NO RESERVATIONS AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
